EU Commissioner Jourová: Privacy Shield, GDPR readiness, online hate speech and more…

Vera Jourová, the European Union Commissioner for Justice, Consumers and Gender Equality, rounded off a recent three-day visit to the US in September with a speech at Berkeley School of Law on the current state of online privacy and consumer protection. Members of our Silicon Valley Privacy and Security team were there in person to hear Mrs Jourová address various topics, including the first joint annual review of Privacy Shield (which she co-launched on 18 September), the progress made for GDPR readiness to date and the ongoing issues of online hate speech and radicalisation.

Originally 261 pages, the GDPR has over 20,000 more words than Shakespeare's Hamlet and has probably resulted in more primers and updates in your inbox than your IT department's imposed storage limits will tolerate. Headlines like: "Companies who've not started GDPR readiness will not be ready on time" and "GDPR fines up to 4% of worldwide turnover" intended to scare, actually scare you. Getting "GDPR ready" may seem a daunting task – but with careful planning, project management and prioritisation, it is an achievable one.

The GDPR's impact on the cloud services provider
At the end of 2015, Europe finally agreed the text of its new General Data Protection Regulation, the law that will replace Europe's aging Data Protection Directive. The Regulation, or GDPR, is the first major re-write of European privacy laws in 20 years, and carries with it a significant extension of liability and compliance obligations. This is particularly the case for the mere data processor (a role familiar to the average cloud services provider). Previously beyond the direct reach of EU data privacy law, the data processor's compliance world will soon change as the GDPR will extend specific legal obligations to data processors.
